Permit Guidelines
To apply, please provide the BTR number, insurance and sign-offs/approval signatures from adjacent businesses and/or applicable homeowner associations.

All business owners are required to obtain and submit the required documents to be eligible for an Ambient Entertainment Permit. The Ambient Entertainment Permit is revocable upon violation of any city, county, state and/or federal law(s) and at any time by the sole discretion of the City Manager.
Local, qualifying, restaurants will be allowed to provide indoor ambient entertainment that does not interfere with the quiet enjoyment of the community and cannot be heard outside the venue, while abiding with all existing City of Miami Beach noise ordinances.
Local restaurants interested in providing live or recorded, amplified or non-amplified performances, with venue occupancy of less than 299 people, will now be allowed to provide ambient entertainment, at volume levels which do not interfere with normal conversation, from 10:00 am to 12:00 midnight, 7 days a week. Initially, the Ambient Entertainment Permits will be limited in numbers and will be in specific neighborhoods where entertainment is permitted, as per the attached map. The City of Miami Beach Tourism and Culture Department will issue permits and Code Compliance will oversee enforcement.
To qualify for this program, restaurants must have an active Business Tax Receipt (BTR) that is in good standing, with no outstanding Code violations, and must abide by the City Code with respect to Arts, Culture and Entertainment, Land Use, Building and Fire regulations.
Interested restaurants must meet the following criteria:
- Restaurants must be located in one of the following areas:
- North of 40 Street
- Collins Park neighborhood (bound by Washington Avenue on the west, Collins Canal, Lake Pancoast and 25 Street on the north, the Atlantic Ocean on the east, and 17 street on the south)
- Zoned district where entertainment is permitted or conditional use
- Restaurants must have the following requirements:
- Occupancy load, as stated on the BTR, cannot exceed 299 people
- Hours of activation are 10 a.m. to midnight, 7 days a week
- Be in good standing with the City of Miami Beach regarding Code violations and
outstanding payments - Have an active BTR
- Provide approved signature survey sign-off from adjacent businesses and/or homeowner associations
- Provide proof of general liability insurance ($1 Million)
Annual application and permit fees are $258 each and will be issued annually from October 1 to September 30 and valid for that fiscal year (the fiscal year starts on October 1 and ends September 30 of each calendar year). Once your application is received, it will be reviewed for completion. Application reviews will not exceed ten (10) business days. city staff will also be available to guide interested establishments through the process. Permits issued in the 2024/2025 fiscal year will expire September 30, 2025. Permit Holders will be notified, 90 days prior to expiration of the permit, for renewal.
